Portlaoise Family Law Court: Family ‘up in a heap’ over assault charge

A SOLICITOR told Judge Susan Fay at a recent sitting of Portlaoise Family Law Court that his client’s family “is up in a heap because he is not allowed back into his house”.

The 43-year-old defendant is alleged to have assaulted his partner on 12 June.

Defending solicitor Barry Fitzgerald said the alleged injured party “has attended court number of times, trying to have the case withdrawn. But I know that the state needs permission from the Director of Public Prosecutions (DPP) to do so. The injured party says that the whole family is up in a heap because he (defendant) is not allowed back into the house”.

Sergeant JJ Kirby said he was not agreeing to withdraw the charge.

Judge Susan Fay adjourned the matter to 6 May for a full hearing into the case.
