Garda Sergeant JJ Kirby told Judge Nicola Andrews at last week’s district court sitting in Portlaoise that there is a delay in proceeding with a case as he has yet to receive directions from the Director of Public Prosecutions regarding whether to prosecute the case at district court or circuit court level.

The issue arose when Luke Gilligan from 33 Rosevale Court, Portlaoise was before the court on a charge of assault causing harm at his address on 16 June.

When Judge Andrews asked Sgt Kirby how the case was to proceed, he replied that as the alleged incident happened recently.

Sgt Kirby said: “I have no directions yet. The case is a bit complicated.” 

Judge Andrews remanded Mr Gilligan on continuing bail and adjourned the case to Monday 2 December.
