A 76-YEAR-OLD man and his 43-year-old son who contributed to the court poor box escaped convictions for public order offences when they returned to Portlaoise District Court last week.

At a previous sitting of the case, the court heard that following the marking of the third anniversary of the passing of their wife and mother, John McInerney, 86 Kirwan Park, Mountmellick and his son Patrick McInerney, Oak Drive, Ballacollig, Mountmellick pleaded guilty to being intoxicated in a public place. Patrick also pleaded guilty to providing a false name and address to gardaí on 27 January on Mountmellick Road, Portlaoise.

The court had been told that at 1.20am, gardaí came across both men stumbling along the footpath in a very drunken state and they were deemed to be a risk to themselves and others and were arrested for their own safety.

When the case returned to court last week, Judge Fay heard that both men had carried out what they had been instructed to do and had donated €150 each to the court poor box.

She went on to apply the Probation Act on both men.
