A MAN who stole a tube of Fixodent, a can of Pepsi Cola and a packet of cheese from a shop in Portlaoise was given the Probation Act at Portlaoise District Court.
Mario Morabito (58) from 11 Loughgate, Portarlington had previously pleaded guilty to the theft of a tube of Fixodent and a package of cheese from Tesco Extra, Fairgreen, Portlaoise on 20 September last year and the theft of a can of Pepsi Cola two days later from the same store.
The court heard that the price of the goods taken amounted to €11.98.
When the case was last before the court, the defendant had been given time to come up with cash to pay for the goods, take part in the Restorative Justice Programme and to engage with the probation services.
At that sitting, Mr Morabito’s solicitor Barry Fitzgerld said his client had developed a reliance on cannabis at the time.
“There was no rationale for what he did,” said Mr Fitzgerald.
He said that Mr Marabito had written a letter of apology and had €100 in court by way of compensation. He said the manager of the Tesco store had asked that the money be donated to the Portlaoise Parish Centre and forwarded to the local church.
