A LOCAL man was disqualified from driving at Portlaoise District Court last week when he was convicted of parking in a disabled bay while collecting a pizza from a takeaway.

Garda Hough said that while on mobile patrol on Main Street, Portlaoise on 14 October last year, she checked a car that had a number of passengers in it that was parked in a disabled parking bay without displaying a disabled parking permit.

She said the driver came from the takeaway and identified himself as John Paul Delaney, 7 Clonrooske View, Knockmay, Portlaoise.

Garda Hough said that Mr Delaney told her that he had a son with a disability and that he had left the disabled parking permit at home. She said that Mr Delaney’s son was not in the car at the time.

Garda Hough said she issued him with a fixed charge penalty notice, but Mr Delaney said he was not paying it, that “he’d take it to court to fight it.” She said that the defendant has 28 previous convictions, eight of those for road traffic offences.

Mr Delaney was not in court when his case was called. Judge Susan Fay acknowledged that the summons for the defendant to appear in court had been served correctly.

She went on to convict Mr Delaney of the offence, fined him €300 and disqualified him from driving for three months.
